Hauptaufgaben Serves as the Senior Post-Trial Paralegal Specialist for the Office of the Staff Judge Advocate (OSJA), 21st Theater Sustainment Command (21st TSC), the geographically largest, most dispersed General Court-Martial Convening Authority (GCMCA) jurisdiction in the Army, comprised of twenty-one subordinate Special Court-Martial Convening Authorities (SPCMCA). In addition to Staff Judge advocate and Deputy Staff Judge Advocate, supports ten Military Justice Judge Advocates and provides guidance to over 15 military paralegals (MOS 27B) and court reporters located at six legal offices located in Germany, the Netherlands, Belgium, and Kosovo. Responsible for accurate and timely Post-trial processing of General, Special, and Summary Courts-Martial to ensure compliance with Title 10, United States Code, Sections 801-946, Uniform Code of Military Justice (UCMJ)- to include the recent and most substantial changes to the UCMJ in fifty years contained in the Military Justice Act of 2016 (MJA16); the new Manual for Courts-Martial (MCM), 2019; U.S. Army Court of Criminal Appeals Internal Rules of Practice and Procedure; US Army Regulation 27-10; and other applicable regulatory or legal directives utilizing Manual for Courts-Martial (MCM). Prepares and finalizes Pre- and Post-Trial actions, memoranda and supplemental orders. Drafts and finalizes the initial promulgating orders for General and Bad-Conduct Discharge (BCD) Special Courts-Martial using the records of trial, legal documents and diverse implementing regulations governing the UCMJ. Ensures accurate terminology and legal sufficiency. Drafts written legal review for to Legal Sufficiency Review by a delegated attorney. Drafts and prepares the Staff Judge Advocate's Recommendation for the Staff Judge Advocate's signature. Reads transcripts and documents, listens to audio files, and examines records to ensure procedural and statutory requirements of the proper authentication of the record, convening orders, pretrial advice, post-trial recommendation with any addenda, service upon the accused, action of the convening authority, promulgating orders, and various other memoranda are legally correct and properly documented in the original and all other copies of the record of trial and all petitions for extraordinary relief. Advises the court reporters of discrepancies. Redacts the accused copy of record of trial, and if applicable, the victim copy. Ensures that all Personal Identifiable Information (PII) is appropriately redacted pursuant to applicable law and regulation. Prints and assembles the accused and victim copy of record of trial. Prepares and serves documents and records of trial on the accused, victim/s, defense counsel, trial counsel and the military judge. Serves as a direct point of contact for Trial Defense Attorneys, prosecutors, court reporters, and the court clerks, etc. in providing update data on General Courts-Martial, Special, and Summary courts-martial processing. Ensures that appellate review requirements are accomplished, prepares final actions for the convening authority, and performs other related duties as prescribed by the Army Court of Appeals for the Armed Forces (A.C.C.A.) and the U.S. Court of Appeals for the Armed Forces (C.A.A.F.). Conducts legal research utilizing online case research tools such as LexisNexis. With the acquired experience within the scope of UCMJ, incumbent utilizes own initiative and personal judgment in ensuring the accuracy of all legal documents. Initiates and processes excess leave of Soldiers pending appellate review pursuant to Army Regulations. Serves as the point of contact for advice and assistance to legal and administrative unit and legal personnel and other command and installation personnel concerning criminal law administrative procedures. Receives and examines all court-martial records of trial, and various other legal memoranda on behalf of the U.S. Army Judiciary. Facilitates the tracking and timely processing of all Post-Trial actions within 21st TSC GCMCA area of responsibility. Maintains Post-Trial control logs and assigns control numbers to all General, Special, and Summary Courts-martial and monitors processing time to ensure compliance with Moreno clock. Maintains records of the status of each pending court action and statistical information required for reporting purposes. Utilizes Military Justice Online (MJO) as the Army's system of record for Courts-Martial processing. Uploads documents to and inputs relevant data into MJO to accurately reflect the Court-Martial Process. Understands the MCM, Army Regulations, A.C.C.A. Post-Trial Handbook, and local installation regulations and policy pertaining to criminal law matters. Collects, analyses, and records military justice data from six legal offices. Cross-trains new incoming senior Noncommissioned Officer-In-Charge (NCOIC) of the Military Justice Division. As necessary, assists NCOIC and Chief of Military Justice with the preparation of pretrial documents, and other documents requiring signature by the Commanding General. Provides annual training to attorneys and paralegals on specific duties, requirements, and recent developments of Post-Trial processing Performs other duties as assigned.
